Supreme Court denies Iowa Pork Prop 12 petition

The Supreme Court recently denied a petition filed by the Iowa Pork Producers Association challenging Proposition 12.

IPPA attorney Eldon McAfee says the challenge to California’s livestock confinement law was based on constitutional issues.

“Some of which were addressed by the dissent mainly in the NPPC case, where the Supreme Court found that it was constitutional. And this was an application to the Supreme Court, and the Supreme Court did not accept that application.”

He tells Brownfield it’s disappointing for Iowa Pork because while producers understand consumers want choice, producers should also be able to choose how their livestock is raised.

“I guess it comes down to consumer choice, slash producer choice, that’s the way it should be. But we firmly believe it shouldn’t be mandated by another state on producers here in Iowa.”

The National Pork Producers Council says it will continue to work with Congressional leaders on a legislative fix to address Proposition 12 and bring some certainty to the pork industry in a “skinny” farm bill.
