Iowa Kennel Owner Loses Final Legal Battle, Forced to Close

An Iowa dog kennel owner has lost her final legal challenge, sealing the fate of her business after a prolonged zoning dispute.

Karen Davis, who operated a kennel on her 22-acre property, had fought to keep her business open after being cited for a nuisance misdemeanor. She argued that local zoning laws should not apply to her kennel, first seeking an agricultural exemption, which the court denied. In a last effort, she attempted to gain protection under Iowa’s home business law, but a judge has now ruled against her.

“They’re saying that should have been addressed at the first hearing,” Davis said. “I’m at the end of the rope, and there’s nothing I can do.”

With her injunction dismissed, the judge ordered that all dogs be removed from her property by April 25. Additionally, the county will inspect the property to ensure compliance.

Pottawattamie County Planning Director Matt Wyant explained that the case stemmed from complaints by local residents.

“These are local residents who live throughout the area that have been having to put up with barking dogs,” Wyant said.

However, not all neighbors agreed that the kennel was a nuisance.

“They’re out in the country, and you hear dogs barking every night, so it’s not an issue,” said nearby resident Heath Hoppes.

Since news of her legal battle spread, Davis says she has received offers from friends, acquaintances, and strangers willing to adopt the dogs. With her legal options exhausted, she is now ensuring all of her remaining German Shepherds go to good homes.

The kennel’s nursery is already empty after the last puppies were sold, and she is now in the process of rehoming the final 15 adult long- and short-haired German Shepherds for free.

“Whenever they’re ready to have their stuff set up for a dog, they’ll be coming to pick them up or I’ll be delivering them,” Davis said.

Despite the legal loss, Davis is focused on ensuring the dogs find safe and loving homes as she prepares to shut down her kennel for good.
