Two people are facing felony drug charges following an investigation at a gas station in Fairfield on Tuesday evening.
Timothy Daniel Fluharty, 48, of Brighton and Hollie Marie Brake, 38, of Wayland have each been charged with two counts of Possession of a Controlled Substance — Third or Subsequent Offense, both Class D Felonies, and Possession of Drug Paraphernalia, a simple misdemeanor.
Officers were dispatched to the 1600 block of West Burlington Avenue at approximately 10:37 p.m. on July 7th after a witness reported observing two individuals seated inside a parked vehicle at a gas station who appeared to be injecting narcotics, with needles visible in their arms. Upon arrival, officers observed the two individuals exit the business and enter a vehicle, with Brake in the driver’s seat and Fluharty in the passenger seat.
Fluharty was confirmed to be on active probation, and a Probation and Parole High Risk Unit officer conducted a search of his person. Officers found a plastic baggie containing methamphetamine in his pocket, along with a used syringe.
Based on the methamphetamine recovered from Fluharty and drug paraphernalia observed in plain view inside the vehicle, officers conducted a search of the vehicle. During the search, officers located Brake’s purse, which contained a hypodermic syringe with approximately 18 cc of methamphetamine, aluminum foil containing suspected methamphetamine, and additional drug residue, according to court documents. Brake confirmed the substances belonged to her. Court documents indicate Brake has two prior controlled substance convictions in Henry County, including a 2019 conviction for Possession with Intent to Deliver Methamphetamine.
A backpack in the vehicle belonging to Fluharty also contained a bag of marijuana, and additional drug paraphernalia including empty bags and two digital scales were found in the vehicle, according to court documents. Court documents note that Fluharty has five prior controlled substance convictions.
Both were transported to the Jefferson County Jail and held on bond pending an initial appearance.
