A Fairfield man is facing an assault charge after allegedly violating an active protective order and assaulting a woman at a Fairfield residence Wednesday, according to a press release from Fairfield Police Chief Joel Smith and Jefferson County court documents.
Kipp Newton, 49, has been charged with Domestic Abuse Assault — Injury or Mental Illness, First Offense, a Serious Misdemeanor, and Violation of a Protective Order, a Simple Misdemeanor. The Jefferson County Attorney’s Office is expected to seek to elevate the domestic abuse assault charge to a Class D Felony — Assault Committed by a Person Against Whom a Protective Order is Issued — as the case progresses.
According to a press release from the Fairfield Police Department and court documents, officers responded at approximately 12:16 p.m. on September 23rd to a residence in the 400 block of South D Street for a report of a disturbance involving a violation of an active protective order. Upon arrival, officers determined Newton was present at the residence despite the protective order prohibiting contact with the victim.
Court documents indicate Newton entered the residence after being allowed inside by the victim, after which a verbal confrontation occurred and escalated into a physical altercation. Officers observed marks on the victim’s neck, which she said occurred during the altercation, and determined there was probable cause to place Newton under arrest. The two are in a relationship, are not married, and have shared the same household for over a year.
Newton also faces a separate domestic abuse charge from an incident in July of this year involving the same individual.
Newton was transported to the Jefferson County Jail and is being held on a $1,000 cash only bond. A no-contact order has been requested. A preliminary hearing is scheduled for October 5th.
