Law enforcement officials were called to a domestic incident involving a physical altercation between two parties, resulting in an arrest and charges being filed following an on-scene investigation.

On March 17 at approximately 11:15 a.m., the Appanoose County Law Center received a 9-1-1 call reporting a possible domestic assault at the 200 block of S. Liberty Street in Cincinnati, Iowa.

According to the Appanoose County Sheriff’s Office, the caller reported that Timothy Moriarty, 35, of Cincinnati, Iowa, “put his hands on the female.” Upon arrival, deputies identified Moriarty at the scene.

Court documents indicate that while speaking with deputies, Moriarty stated that the victim had gone out the previous night and did not return home. He advised that he suspected infidelity. Moriarty further stated that he told the victim to gather her belongings and leave the residence.

According to court filings, Moriarty reported that when the victim arrived, she began yelling and breaking items inside the home. Deputies observed a hole in the wall behind the back door and a broken plastic shelf from the refrigerator.

Moriarty told authorities that he pushed the victim out the door to prevent further damage. He also stated that the victim attempted to re-enter the home through a kitchen window, and that he pushed her out through the window as well. During the altercation, Moriarty reported that the victim “latched” onto his arm, scratching him. Deputies observed red marks on his arm consistent with this account.

Moriarty also alleged that the victim accused him of striking her in the head during the incident.

Deputies spoke with the victim, who stated she returned to the residence to retrieve her belongings and was immediately told to leave and repeatedly pushed out of the home. She also reported that she attempted to re-enter through a kitchen window and was again pushed out.

Moriarty was arrested and transported to the Appanoose County Jail. He was later released. A no-contact order was issued on March 18. A preliminary hearing is scheduled for April 14.

Moriarty has been charged with domestic abuse assault, a simple misdemeanor.
