Eldon Man Facing Child Porn Charges Likely to Have Trial Delayed

The Eldon man facing federal child pornography charges likely will not go to trial until sometime next year.

Troy Davis faces three felony counts in federal court, for receipt, possession and transportation of child pornography. His trial was scheduled for October 28th, but this week, his lawyers asked the court to delay the trial until March of 2020. They said they needed more time to investigate the charges, but they also raised the possibility of entering into plea negotiations. Prosecutors in the case are not objecting to the request for a delay.

Wapello County sheriff’s deputies arrested Davis on August 20th on a U.S. Marshall’s warrant, acting on a tip given to the National Center for Missing and Exploited Children. Authorities say Davis has admitted to sending and receiving images of child pornography, and a search of Davis’ social media accounts revealed multiple graphic images of young boys.

Court documents say Davis was in possession of several pornographic images, including some of children under the age of 12. Davis is also already a registered sex offender. In 1998, he pleaded guilty in Wapello County court to two counts of lascivious acts with a child.

As a reminder, a criminal charge is only an accusation, and a defendant is presumed innocent until proven guilty.
