An Ottumwa man allegedly attempted to resist arrest after driving under the influence with his child in the vehicle.
20-year-old Franklin Maldonado was charged with neglect or abandonment of a dependent person, interference with official acts, public intoxication, assault on person in certain occupation, and operating while intoxicated – 1st offense.
On September 28 at 7:00 p.m., court records say Maldonado made contact with officers while he was driving while intoxicated with his 2-year-old in the vehicle. Authorities conducted a Preliminary Breath Test which registered a BAC of over .08%.
During the arrest, Maldonado refused to put his hands behind his back and pulled away from officers. Maldonado kicked an officer in the leg while being escorted to the back of the patrol car.
Maldonado was transported to the Wapello County Jail. He has a $10,000 bond and pleaded not guilty at his initial appearance. He has a preliminary hearing on October 8.
