The Jefferson County Attorney’s Office announced the arrest of a Fairfield man for sexual assault.
David Michael Phipps, 32, was charged with third-degree sexual abuse, a Class C felony.
Jefferson County Attorney Chauncey Moulding alleges in the early morning hours of May 21, Phipps perpetrated a sex act against a person who was mentally incapacitated and incapable of providing consent.
Phipps is currently in the Jefferson County Jail on a $10,000 bond.
Third-degree sexual abuse carries a maximum sentence of 10 years in prison.
