Davila Gets 50 Year Sentence

An Ottumwa man will spend at least 35 years behind bars after shooting and killing another man.

A jury found Erik Davila guilty of second degree murder in June. He was sentenced on Monday to serve 50 years behind bars, not becoming eligible for parole until he has served at least 70% of his sentence.

Prosecutors charged Davila with first degree murder after the March, 2016 shooting death of 24 year old Hugo Hernandez of Ottumwa.

Defense attorneys were successful in arguing that Davila’s level of intoxication mitigated his responsibility in the crime. A jury agreed finding him guilty of the lesser charge of 2nd degree murder. He’d faced life in prison without the chance for parole if found guilty of first degree murder.

Davila was also ordered to pay the hernandez family restitution of $150,000.
